Jewish Yellow Plus Agreement and Terms of Use

Dear Surfer,
We thank you for choosing to enter the Jewish Yellow Plus website and/or any page and/or section thereof (hereafter referred to as "J site"). Jewish Yellow Plus (hereafter referred to as "JewishYellowPlus", or JYPlus) is an Internet site run by a private entity, which deals, among other things, with providing advanced services through the Internet, and it operates and manages the Internet portal that you are surfing on now. This site is a site run by Jews for worldwide Jewry and the entire Jewish people. It includes within its operation many subjects of Jewish interest. These terms of service govern the relationship between JYPlus and the surfers on the site, and subject to the rules of these terms of use you may participate in public auctions, purchase products and/or services offered and/or publicized on the site, and join virtual communities, forums, chats, open blogs, videos, locate and receive information and/or content of specific types and/or of different subjects, perform searches etc. (hereafter referred to together as - "the services"). Within the framework of these terms of use a surfer is to be interpreted as - any person and/or corporation and/or body whatsoever. The term JewishYellowPlus is to include its directors, workers, stockholders, forum managers and anyone on its behalf. Everything in these terms of use referred to in the feminine should be understood also in the masculine. Everything in these terms of use in the singular should be understood to refer also to plural.

General

Surfing and/or entering the site and/or using the services is considered to be agreement on your part to the conditions of these terms of use. If you do not agree to all or any of the conditions of use, including our Privacy Policy, you are prohibited from using the J site and/or the services for any purpose. JYPlus reserves the right to update the conditions of use from time to time, according to its sole discretion, and without any prior notice and these conditions will be binding from the moment of their publication on this site. J site is for private use only and not commercial and/or wholesale use, unless specifically stated otherwise. The surfer will keep confidential, will not reveal or transfer to other/s, his/her username and/or personal passwords. It is prohibited to make any use whatsoever with the JYPlus databases or any part of them without prior and written approval from The JTPlus. The surfer declares that he/she knows that on the Internet there may be sites that are permissible for viewing only to adults (over 18 years old) and may contain pornographic material, and it is the surfer's sole responsibility for using and supervising the viewing and use thereof, and the surfer exempts JYPlus from any responsibility and/or liability in relation to this.

Intellectual Property

The copyrights and intellectual property on the J site and the services belong to JYPlus or to third parties that permitted JYPlus to use them in the framework of the site and the said services. Included in this, and without detracting from the aforementioned, JYPlus is the sole owner of the names and commercial symbols of the site, patents and polls on the site, whether they are registered or not, the commercial secrets connected to running the site and providing the services, in the design of the site, the technological information necessary for running it, including but not limited to software, applications, graphic files and others, computer code, texts, and/or all other material included in it (hereafter referred to as "the information"). It is prohibited to copy, distribute, display publicly or transfer to a third party the information and/or any part of it. It is prohibited to change, publicize, broadcast, transfer, sell or distribute or make any use whatsoever of the information and/or any part of it whatsoever, without the prior written consent from JYPlus.

Surfer Content

Any content posted or provided to the site by a surfer, including pictures in Blogs, movies on Blog TV, chat room messages and/or any other material posted on the site by a surfer (hereafter: "Surfer Content") are the sole possession and responsibility of the surfer who posted the said content. The surfer is prohibited from misrepresenting him/herself and/or posting or providing false information, including but not limited to marital status, profession, age etc. The surfer grants the JYPlus permission to make any use whatsoever with the surfer content, whether by itself or through others on its behalf, including copying the content and/or distribution through the various media forms, according to its sole and complete discretion, including the internet, newspapers, cellular media and/or television, and all with receiving additional permission from the surfer and/or paying any consideration whatsoever for the said use, including the case where JYPlus profits for the use of the said surfer content. The surfer fully exempts JYPlus totally, finally and completely from any liability whatsoever for any damages, losses or expenses of any type, caused or which will be caused and are connected in any way, directly or indirectly, to surfer content posted and/or appearing in Blog TV and/or anywhere else on the J site. In addition the surfer undertakes and agrees to compensate and indemnify JYPlus for any damages, losses or expenses, of any type, caused or which will be caused to JYPlus, and which are connected directly or indirectly to surfer content and which are posted an/or appear on Blog TV and/or anywhere else on the J site, immediately after JYPlus's first demand, and the surfer waives completely and unconditionally any rights or claims vis a vis JYPlus connected to said content.

Liability Limitation

Jewish Yellow Plus does not undertake that the services will not be disrupted or will be provided without interruption, will be provided safely without mistakes, and will be immune to unapproved access to JYPlus computers or from damages, problems, disruptions, or hardware or software breakdowns, telecommunication lines and systems at JYPlus or any of its service providers an/or anyone on its behalf. JYPlus provides the services "as is" "with all faults" and "as available", and the entire risk as the satisfactory quality, performance, accuracy and effort is with the surfer. To the maximum extent permitted by applicable law, JYPlus makes no representations, warranties or conditions, express of implied. The provision of services by JYPlus is dependent, among other things, on third parties, and JYPlus is not responsible or liable for any action or non-action by third parties and will not be liable for any damages and/or loss and/or expenses that will be caused to a surfer and/or to any third party as result of any said action or non-action. WorldofJewish is not responsible for the availability of the services and/or the content, for the form, credibility, reliability, exactness of the surfer content as defined previously in these terms of use, including not being responsible for damage or violation of intellectual property rights whatsoever, including trademarks and commercial secrets, in relation to surfer content or relating to any other use that surfers make of the JYPlus site and the services offered and included in it. As all other content appearing on the internet, surfer content is open and may be seen and used by any other surfer on the network, and JYPlus is not responsible or liable for the security of the surfer and/or any damage or loss or expenses that will be caused to the surfer and/or any third party as a result of this. JYPlus does not control and does supervise and is not responsible for the information and/or services provided and/or publicized by others and/or by it, whether directly or indirectly, including the services and site content of others connected by links from the J site. Publicizing surfer content or a link in the J site by JYPlus will not be interpreted as an offer to the surfer, as a show of support, approval or patronage by JYPlus to the content and/or services offered by others. Any reliance by a surfer on any content, information, advertisements, products, opinions and stances which appear or are publicized on the sites which are accessible from the J sited, including information, content, opinions, and stances which appear or are publicized there, are at the sole discretion and responsibility of the surfer. Jewish Yellow Plus is not responsible for any damage, direct, indirect, circumstantial, consequential and/or incidental, special or punitive damages, inability to use, loss of data and/or loss of profits resulting from the use of the services and/or all information, content, services or products on the J site and/or that can be accessed through the J site, even if Jewish Yellow Plus supervised in any way the content placed on the J site or that can be accessed or viewed by way of the J site, and even if it became known to JYPlus the possibility of such damage that may be caused to a surfer and/or any third party, in relation to Jewish Yellow Plus and/or services, the use of them, the inability to make use of them, their cancellation, limitation or interruption . In the case thaJYPlus, without being required to and from its own goodwill tried to aid in solving a problem or request from a surfer, this aid will not be interpreted in any way as placing any responsibility or liability on JYPlus.

Protection of Privacy

Surfing on the J site and the use of the services included in it is an agreement by you that JYPlus can utilize computer supervision of the use you make of the services, through the use of "cookies" and/or other similar says. JYPlus is permitted to use all said information for purposes of control and/or supervision and/or development and/or guarding the quality if the services, their level, working order and/or in order to comply with any laws, and /or for its own purposes, including service and polls of JYPlus. JYPlus strictly complies with all applicable laws of the State of Israel, including the law of guarding privacy and it will guard the privacy of the surfers and will not reveal to anyone not permitted by law, any lists or documents containing names and addresses of the surfer or any other information about the surfer, except for details and information which are public and have been publicized by the surfer him/herself. Surfing the J site is considered to be agreement by you that JYPlus will make use of your details to receive updates and/or advertising information and/or marketing information through your e mail address. If you do not agree to this, you must notify JYPlus in writing.

Termination, Interruption and Changes

JYPlus is permitted to remove content and/or sites from the services, according to its sole and complete discretion and without the need to notify the surfers, including blocking and/or limiting and/or terminating the provision of the services in circumstances when a surfer made use of the services in a way that may cause disruption to the services, to other surfers, or in a way that is a civil wrong or criminal act, or in a way which raises reasonable suspicion that the surfer is acting in a way which violates the conditions set in these terms of use. In addition JYPlus is permitted to terminate or discontinue or limit the provision of the services at any time, including but not limited to, the necessity to perform acts of upkeep or establishment which are crucial and immediate for the system which serves it, or in times of national emergency or for reasons of national security. The limitation or termination or blocking of the services, as aforementioned, do not in any way make JYPlus liable in any way, or detract in any way from the obligation of the surfer to act at all times in accordance with these terms of service. JYPlus may change from time to time the structure of the J site, its look, the services offered on the J site, their scope and/or availability and any other aspect connected to them - an all without the need to notify the surfer. The surfer will not have any suit, claim, demand or cause of action against JYPlus for making changes as aforementioned and/or for problems that may occur while making said changes.

Declarations and Obligations of the Surfer

In addition, and without detracting from the generality of these terms of service, each surfer declares and obligates themselves vis a vis JYPlus as follows: " Not to use content which contains a nature, which is threatening, vulgar, racist or insulting or post pornographic material or of a vulgar sexual nature or that may hurt the feelings of the community. Not to sexually harass other surfers and make indecent remarks. Not to include in surfer content or Blog TV and/or to any service of JYPlus, material which will violate the privacy and or invade the privacy of others, cause rebellion, mislead, violate copyrights, patents, trademarks etc., violate any other rights of third parties, commercial wrongs and/or violate the right to one's good name and/or violate contractual rights and/or obligations of trust towards others and/or any other violation of any law. Not to flood forums with notices, that does not allow for a reasonable discussion in the forum. Not to post content that contains publication of spam, garbage e-mail or sending many e-mail messages or SMS when not requested to by those receiving the messages. In addition, not to include content relating to, indirectly or directly, cellular telephones and/or end-user equipment, and/or any type of service that is provides or will be provided directly or indirectly by any of the providers of cellular telephone service, except if prior written approval is given by the providers of the cellular telephone services. Not to make use of vulgar language that insults or hurts other surfers on the forum. Not to harass other surfers in the forum, not to hurt other surfers and not to violate the law in any other way. Not to post on the site any illegal material, or material which encourages, supports, aids, gives instructions to perform acts which are criminal acts according to the laws of the State of Israel. Not to include any libelous material. Not to include any material whose publication has been prohibited by law. Not to incite to racism, hurting others, murder or violating the law. Not to publicize personal information of other surfers or telephone numbers. Not to publicize commercial advertisements on the forums on the J site. Not to use the services of JYPlus or performing illegal acts. To use the services according to the terms of use, according to applicable law and subject to rules of use and instructions included in this agreement and which may be also given to the surfer from time to time by JYPlus. Not to invade material and/or computer files illegally and/or to transfer computer programs, computer code or applications that include computer viruses, including programs which are known as Trojan horses, worms, vandals and malicious applications etc, to other computers and/or to use or bother other computers in violation of the Computer Law - 1995. Not to send e-mail messages in a manner causing complaints by those who receive them. Not to include any material relating to minors and which identifies them, their details or addresses and ways of making contact with them. Not to include passwords, user names and other details, which allow use of computer programs, digital files, internet sites or services requiring registration or payment, without payment or said registration. Not to include any material which may mislead the consumer, as defined in the Law of consumer Protection - 1981. Not to post any links or direct to material that its publication is prohibited according to this document." A surfer, or user, who acts in violation of any of the obligations, as stated above, will be blocked, the content that they posted will be removed, and JYPlus will be allowed to block them and prevent them from surfing on the J site and consuming the services on the site. A surfer who was banished by JYPlus and/or their entry was blocked, will not be allowed to return to surf under another username. The surfer will indemnify JYPlus immediately upon first request to do so, for all damages and/or losses and/or expenses, including legal fees, which will be caused to JYPlus and/or to any third party as a result of the surfer's use of the J site and/or its services, and the surfer waives completely, totally and for all time any claim or demand from world of J relating to surfing on the J site and the use of said services. Choice of Law and Location for Resolving Disputes The laws of the State of Israel will apply to these terms of use and everything resulting from them or related to them, the terms of use will be interpreted according to those laws, and any disagreement or legal question relating to them will be adjudicated only in the authorized court in Tel Aviv - Jaffa.
